It was the Tribunal’s considered view that the Appellant failed to discharge its evidential burden of proof under Section 107 (1) of the Evidence Act in demonstrating that the Respondent’s decision in rejecting the Appellant’s late notice of objection was in any reasonable manner improper or arbitrary.
